1. Your agreement with us
These Terms govern your use of AELDER at aelder.dev, including the website, API and account dashboard (the “Service”). References to “we”, “us” and “our” mean the operator of the Service.
By creating an account or using the Service, you agree to these Terms. If you use it for an organisation, you confirm that you are authorised to accept these Terms on its behalf. You must have legal capacity to enter into this agreement and comply with the laws that apply to your use.
The summary above is for convenience. The sections below set out the full terms. Nothing in these Terms excludes rights or remedies that applicable law does not allow us to exclude.
2. What the Service provides
The Service provides access to AI models through an OpenAI-compatible API, with a single account, API keys, a prepaid balance and usage records. Chat completions support streaming and tool calls. An Anthropic-compatible /v1/messages endpoint is also available.
Model versions, quantization, reasoning settings and supported features can differ between API services. Check the exact model ID and configuration available to your account. Responses can vary between calls and environments; an identical response to another API is not guaranteed.
We operate an independent service. References to model names identify the models available for use and do not imply affiliation, endorsement or official partnership with their developers.
We take reasonable steps to operate the Service, account for usage and investigate reported billing problems. Confirmed errors in our billing or deposit crediting will be corrected.
3. Your account and API keys
Provide accurate account information and keep your credentials and API keys confidential. You are responsible for the applications and people you authorise to use your account, for monitoring usage and for revoking keys you no longer need.
If you suspect unauthorised access, revoke affected keys and contact our support team using the contact details published on the website promptly. We will review reported incidents; responsibility for disputed usage will depend on the circumstances and applicable law.
Do not expose secret keys in public repositories, client-side applications or shared files. We may restrict access or revoke credentials when reasonably necessary to investigate compromise or protect accounts.
4. Acceptable use
Use the Service lawfully and respect the rights of others. You are responsible for your inputs, your applications and how you use model outputs. If you provide access through an application, take reasonable steps to prevent misuse by its users.
We may reject requests or restrict access where reasonably necessary to enforce these rules, comply with law or protect the Service. Affected requests may also be refused by the infrastructure processing the selected model.
- Do not submit illegal content, infringe privacy or intellectual property rights, or exploit or sexually abuse children.
- Do not use the Service for fraud, malicious software, unauthorised intrusion or attacks on people or systems.
- Do not bypass billing, authentication, rate limits or access controls, or deliberately overload the Service.
- Do not obtain bonuses through fake accounts, fraudulent payments or other manipulation.
5. USDC payments, pricing and usage
The Service uses a prepaid, pay-as-you-go balance. The minimum top-up is $5 as displayed in the dashboard. There is no subscription or mandatory monthly fee. Top-ups are paid in USDC using a network supported at checkout.
Only use the token, network and deposit address specified at checkout. Blockchain transfers may be irreversible. We cannot guarantee recovery of funds sent to an incorrect address or unsupported network. Contact support if a confirmed payment has not been credited.
Rates are displayed in dollar-denominated service credits. Each USDC received is credited as one dollar of paid service balance, before any separately disclosed payment fee, with promotional credit added separately. Service credits are for API usage and are not a bank deposit or an investment. We do not guarantee the market price or continued peg of USDC.
Each top-up is valid for 12 calendar months from the date it is credited. Any unused paid credit from that top-up expires automatically at the end of that period and is removed from your available balance. Each top-up has its own expiry date; further top-ups or account activity do not extend the validity of earlier credit. Expired credit cannot be used, restored or refunded, except where required by applicable law. Expiry does not cancel a refund already owed under these Terms.
Charges depend on the selected model and the input, output and cached tokens used, at the applicable rates. Very small requests have a minimum charge of $0.00002 in the displayed pricing units. The dashboard records usage and cost.
Usage already processed may be billed even if your application disconnects, stops a stream or does not use the output. An interruption does not by itself mean that no tokens were processed. Correctly metered usage is not refundable merely because an output does not meet your expectations. Report suspected billing errors so we can check the usage records and correct confirmed incorrect charges.
Price changes apply to future requests and do not reprice completed usage. We will communicate material pricing changes before they take effect. Stop making requests if you do not accept the new rates.
6. Promotional and bonus credit
The first top-up receives matching bonus credit up to $20 in displayed balance units. Amount-based bonuses are 5% for top-ups from $20, 10% for top-ups from $50, 15% for top-ups from $100. The first-top-up and amount-based bonuses add together.
Paid funds and bonus credit are accounted for separately. Paid funds are spent first; bonus credit is used only after the paid balance has been exhausted. Bonus credit is promotional, has no cash redemption value and is excluded from refunds.
Bonus credit attached to a top-up expires with that top-up, 12 calendar months after crediting, unless a shorter promotional period is disclosed before participation. Other promotional credit expires 12 calendar months after it is credited unless a shorter period is disclosed. If a top-up is refunded, the unspent bonus attached to that top-up is cancelled. Bonus credit is not transferable and ends when the account or Service closes. We may reverse credit obtained through fraud or an accounting error. Changes to a promotion apply to future top-ups and do not retroactively remove valid existing credit.
7. Refunds of unused paid funds
You may request a refund of the unused paid portion of a top-up within 7 calendar days after that top-up is credited. Send your request to our support team using the contact details published on the website with your account email, payment date, amount and transaction reference. Each top-up has its own 7-day request window.
The refundable amount cannot exceed the unused paid funds attributable to an eligible top-up. Amounts already spent on correctly billed usage and all bonus or promotional credit are excluded. Paid deposits are used in the order they were credited, oldest first. All paid funds are used before bonus credit.
Refunds are made in USDC within 14 calendar days after we receive a valid request and the information reasonably needed to verify it and confirm the receiving address and network, unless applicable law requires an earlier deadline. You must provide accurate refund details. Any unavoidable blockchain transaction fee deducted from the refund will be disclosed before you confirm the transfer, to the extent permitted by law. We do not add a separate refund administration fee.
This 7-day policy is an additional contractual refund option. It does not shorten any mandatory withdrawal period or remove rights to remedies under applicable law. Where mandatory law requires a different process or deadline, that law prevails.
Reported billing errors are considered separately from a change-of-mind refund. Contact us promptly if a payment was duplicated, a confirmed payment was not credited, or usage was billed incorrectly.
8. Availability and changes to models
We take reasonable steps to maintain the Service. Execution also depends on external model-processing infrastructure. Maintenance, outages, capacity limits, safety checks and changes to models can cause delays, rejected requests or temporary interruptions.
We do not guarantee continuous availability, a particular response time, throughput or continued access to every model. No service-level agreement or automatic service credit applies unless separately agreed in writing or required by law.
We may add, update or retire models and features. We will give reasonable notice of material changes where practicable, except where urgent security, legal or operational issues require immediate action. Changes do not remove applicable refund rights.
9. Your content and AI outputs
You retain the rights you have in your inputs. You grant us only the permission needed to transmit and process your inputs and outputs to provide the Service. You must have the rights and permissions necessary to submit those inputs.
AI outputs may be inaccurate, incomplete, biased or unsuitable for your intended purpose. Independently evaluate outputs before relying on them, executing generated code or using them in decisions with significant consequences. The Service is not a substitute for qualified professional advice.
We do not promise that an output is unique, eligible for intellectual property protection or free of third-party rights. Any rights in outputs depend on applicable law and the terms governing the selected model.
10. Request processing and privacy
Our Privacy Policy describes how we handle account information, usage records, payments, website analytics and request content. We do not save prompt or response content in our platform logs or use it to train models.
Request content passes through our platform to external infrastructure for execution. External parties apply their own retention and data-use policies, which may allow use for training. Our no-training commitment applies to our own activities; we cannot guarantee the same treatment outside our platform.
Do not submit passwords, API keys or confidential information if this processing is unacceptable to you. You are responsible for ensuring that you have a lawful basis to submit personal data about other people.
11. Service provided as is
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”, without express, implied or statutory warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant uninterrupted or error-free operation, absolute security, the accuracy of model outputs, or achievement of any particular technical, financial or business result. This disclaimer does not override specific express commitments in these Terms or warranties and remedies that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses, including lost profits, lost revenue, lost anticipated savings, business interruption or lost business opportunities arising from use of, or inability to use, the Service.
To the fullest extent permitted by applicable law, our total aggregate liability arising from or relating to the Service is limited to the amount you paid for API usage during the 30 calendar days immediately preceding the event giving rise to the claim. Unused deposits and promotional credit do not increase this cap. This cap applies regardless of the legal basis of the claim and even if we were advised that a loss was possible.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct or any other liability that applicable law does not permit us to exclude or limit. Mandatory consumer and data-protection rights remain unaffected. The limitations above do not cancel an obligation to return funds owed under our refund terms or correct confirmed billing errors.
13. Account closure, suspension and service shutdown
You may stop using the Service at any time and contact support to request account closure. Closure does not erase amounts already owed or automatically create a refund entitlement beyond these Terms and applicable law.
We may suspend or terminate access for material violations, fraud, account compromise, legal requirements or risks to the Service. Where lawful and practicable, we will give a reason and an opportunity to contact support. An urgent protective suspension may take effect immediately. Suspension alone does not automatically forfeit unrelated paid funds.
If we permanently discontinue the Service, unused paid funds will be refunded within 90 calendar days of the shutdown date. Contact our support team using the contact details published on the website to arrange verification and provide refund details. Bonus credit is excluded. We will communicate the shutdown and refund process through the Service or account contact details where practicable. A shorter mandatory deadline takes precedence.
Account closure and deletion are subject to the retention obligations described in the Privacy Policy. Sections concerning completed usage, refunds, intellectual property, liability and disputes continue to apply where relevant after closure.
14. Changes, applicable law and disputes
We may revise these Terms to reflect changes to the Service or legal requirements. We will update the date above and provide reasonable advance notice of material changes through the Service or by email, unless an urgent legal or security reason prevents it. Changes do not retroactively alter completed charges or accrued refund rights.
Applicable law and the competent courts are determined by the rules that govern the agreement and the dispute. These Terms do not require you to waive mandatory consumer protections or a right to bring proceedings in a court available to you under applicable law.
Please contact our support team using the contact details published on the website first so we can investigate a concern and try to resolve it. This does not prevent you from using a lawful complaint, dispute or court process.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These Terms, together with any expressly agreed additional terms, form the agreement for use of the Service. Our Privacy Policy is the accompanying notice about data handling.
